Three people, including ex-NAB employee, sentenced for trying to defraud bank of $21 million

Three people, including a former National Australia Bank (NAB) employee, have been sentenced for their roles in a scheme which attempted to defraud the bank of $21 million.

Monika Singh, who worked as a senior associate at NAB's Sydney branch, was handed a sentence of three years for nine fraud-related offences.

A jury found in September that Singh conspired with former mortgage broker Davendar Deo and IT consultant Srinivas Naidu Chamakuri to use fake vouchers to attempt to steal the money.

The jury also found that Chamakuri and Singh worked together to use fraudulent bank guarantees to purchase property in exchange for commissions.

Deo was given a sentence of two years and six months, while Chamakuri was sentenced to three years.

All three offenders, however, were allowed to walk from the court while reports are prepared into whether home detention, rather than jail time, was appropriate in each case.

Justice Donna Woodburne asked their respective lawyers to make it clear to them that jail was still a possibility.

She said Singh took advantage of her position as a bank employee.

"[There was] disregard for the trust that had been placed in her by her employer to engage in fraudulent offending by her and her co-offenders," Justice Woodburne said.

She said it was important to consider the impact that jail time would have on her primary school-aged daughter, who would have to live with extended family in the United States.

Lack of genuine remorse

The three pleaded not guilty to a total of 19 charges, with Justice Woodburne finding each lacked genuine remorse to some extent.

"While each played different roles, they were involved in the same criminal enterprise," Justice Woodburne told the court.

"Each have significant personal circumstances worthy of weight in the determination of an appropriate sentence."

Justice Woodburne said Deo had previously told the court he believed he was "helping a friend".

She rejected that excuse.

"I do not accept that, as a licensed mortgage broker, he did not understand that obtaining and passing on his clients' financial details was a breach of trust and constituted criminal conduct," Justice Woodburne said.

She said Chamakuri had told the court, "I am truly remorseful for the position I find myself in".

Justice Woodburne said that did not constitute him taking responsibility for his actions.

Chamakuri continued to deny responsibility when questioned by reporters outside court.

"I didn't do anything," he said.

"There's no money lost. It's only framed."

The three will report daily to police until reports are prepared on the suitability of home detention, set to be tabled in court on March 21.
